Terms of Service

Please read these Terms of Service ("Terms") carefully before using Valise ("the App"), developed by Magenta Creations ("we", "us", "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Description of Service

Valise is an application for Mac and iPhone that sets up a file-transfer service in your own Cloudflare account — an R2 bucket and a Worker — using the sign-in or API token you provide, and sends files through it. The bucket, the Worker and every file you send live in your Cloudflare account. We do not host, store or transmit your files.

2. Acceptance of Terms

By using Valise, you agree to these Terms. If you do not agree, do not use the App. We may update these Terms; continued use of the App after changes constitutes acceptance of the updated Terms.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Valise for personal or commercial purposes, subject to these Terms and to Apple's Licensed Application End User License Agreement. The Worker the App deploys into your account is part of the App and is covered by the same license. You may not:

• Reverse engineer, decompile, or disassemble the App, except where the law allows it
• Modify, adapt, or create derivative works based on the App
• Redistribute, sublicense, or resell the App
• Use the App to violate any applicable laws or regulations

4. Purchases

Some features, such as password-protected transfers, are part of an in-app purchase ("Valise Pro"). Its price is shown in the App Store before you buy. Payment is processed and charged by Apple, and refund requests must be directed to Apple in accordance with their refund policy. We do not process payments or refunds directly.

5. Your Cloudflare Account

Valise works inside your Cloudflare account, and that account is yours: its use is governed by your agreement with Cloudflare, and Cloudflare bills you directly for what your transfers use — storage and operations beyond your plan's free allowance. You acknowledge that:

• You are responsible for the security of your Cloudflare account and API tokens
• You are responsible for any charges Cloudflare makes for the resources Valise creates
• Valise creates and changes resources in your account only after showing you what it will do, and you are responsible for reviewing that before confirming
• Deleting a transfer, or letting it expire, permanently deletes its files from your bucket; keep your own copy of anything you need

6. What You Send

You are solely responsible for the files you send with Valise and for whom you share links and passwords with. Anyone holding a link can download its files until it expires or you delete it, unless the transfer has a password. You must have the right to share what you send, and must not use Valise to distribute unlawful content.

7. Intellectual Property

Valise, including its design, code, and branding, is the intellectual property of Magenta Creations. All rights not expressly granted in these Terms are reserved.

8. Disclaimer of Warranties

Valise is provided "as is" and "as available" without warranties of any kind, either express or implied, to the extent permitted by law. We do not warrant that:

• The App will be error-free or uninterrupted
• The App will meet your specific requirements
• Every transfer will complete or remain available until its expiry

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, charges from Cloudflare, loss of profits, or business interruption, arising from your use of Valise.

10. Third-Party Services

Valise relies on Cloudflare's services. We are not affiliated with, endorsed by, or responsible for Cloudflare. Your use of Cloudflare is subject to its own terms and policies.

11. Termination

We may terminate or suspend your access to Valise, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

12. Governing Law

These Terms are governed by French law, without regard to conflict of law principles, and any dispute falls under the jurisdiction of the courts of Paris. Nothing in them limits the rights you have as a consumer under the law of the country where you live.
